WASHINGTON — The Supreme Court has turned down an emergency appeal from a New Jersey man who says President-elect Barack Obama is ineligible to be president because he was a British subject at birth.

The court did not comment on its order Monday rejecting the call by Leo Donofrio of East Brunswick, N.J., to intervene in the presidential election. Donofrio says that since Obama had dual nationality at birth _ his mother was American and his Kenyan father at the time was a British subject _ he cannot possibly be a "natural born citizen," one of the requirements the Constitution lists for eligibility to be president.

Donofrio also contends that two other candidates, Republican John McCain and Socialist Workers candidate Roger Calero, also are not natural-born citizens and thus ineligible to be president.

At least one other appeal over Obama's citizenship remains at the court. Philip J. Berg of Lafayette Hill, Pa., argues that Obama was born in Kenya, not Hawaii as Obama says and the Hawaii secretary of state has confirmed. Berg says Obama also may be a citizen of Indonesia, where he lived as a boy. Federal courts in Pennsylvania have dismissed Berg's lawsuit.



This lawsuit is kind of ridiculous to begin with as the FBI checks out every Presidential candidate in detail...they got all the info on him and know where he was born.

Dragon Horse, this issue has provoked considerable debate on a website called anthroscape. It seems strange that this issue is being brought up after Obama has won the presidency. It seems to me that some people have an issue with Obama having won.

ya think. Laughing Actually it was brought up before the election. It took this long to make it through the courts.

And rightly so. The Secretary of the State of Hawaii has confirmed that Barack Obama was born in Hawaii as Barack has said. A waste of time and energy. This case was baseless and few thought the SC would take it up. It appears they were correct.

Really, I never heard of it being mentioned during the elections and I watched that coverage extensively.

Really, I never heard of it being mentioned during the elections and I watched that coverage extensively.


I saw it about 1 week before the election on CNN in the morning, that is the only time I saw it on tv, but it was floating around the net on right wing sites for awhile...
